Marshall Medical Center respects your right to privacy. This Website Privacy Policy discloses how we gather, use and disclose information about you when you use or access our website located at https://marshallmedical.org or other websites owned by Marshall Medical Center (the “Site”)

This Website Privacy Policy describes our information practices with respect to the Site and applies to data you provide through the Site. This Website Privacy Policy is in addition to, and does not replace, our Notice of Privacy Practices, which explains how we use and disclose our patients’ protected health information (“PHI”) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). To the extent of a conflict between the terms of this Website Privacy Policy and the Notice of Privacy Practices with respect to PHI, the Notice of Privacy Practices will control how we use and disclose your PHI.

Children’s Privacy

In accordance with the Federal Children’s Online Privacy Protection Act of 1998 (“COPPA”) Marshall Medical Center does not knowingly collect or solicit personal information from anyone under the age of 13. Please be aware that our Site is not intended for or designed to attract children. If you are under 13, do not send your information to us unless you are registered as an emancipated minor or a minor receiving services you are legally allowed to receive without parental consent. If we learn that we have improperly collected personal information from a person under age 13, we will delete the information. If you believe that we may improperly have information from or about a person under the age of 13, please contact us at compliance@marshallmedical.org.

Information We Collect About You

Information You Give Us

We collect Personal Information from you directly when you fill out any forms on the Site or email us requesting information. Also, depending on the Site or the services available to you on a Site, we may request specific Personal Information necessary to perform the services. You are under no obligation to provide any such information. Information that may be collected include, but are not limited to, individual identifiers such as your real name, alias, postal address, email address, telephone number, and birth date or age.

When using our Career site, we will collect additional personally identifiable information including demographic information and characteristics of protected classifications including marital status, sex, age, and military and veteran status; employment status, and name of employer.

Information We Collect Automatically When You Use Our Website

During your visits to our Site, we may automatically collect the following information:

  • Log Information. We may automatically collect information about your use of our Site or other websites including your Internet Protocol (“IP”) address, login information, demographic information (e.g., age or gender), your device’s model and manufacturer, location information, MAC address, web browser, and operating system, performance issues, and your activity on the Site.
  • Visit Information. When you visit the Site, we may automatically collect information about your visits, including the URL, pages viewed, links clicked, access times, page response times, length of visits to certain pages, methods use to browse away from the page, domain names, and other statistical data involving the use of our Site. In our normal course of business, we use Personal Information to respond to your inquiries. We may also use Personal Information to notify you of events, products, or services that we think may be of interest to you. If you decide at any time that you no longer wish to receive notifications from us, please refer to the paragraph below captioned “Changing or Deleting Personal Information.” Additionally, Marshall uses Personal Information about you for the following purposes:

  • to keep you informed of products and services we think may be of interest to you;

Marshall will only process Personal Information as described in this Policy, as permitted by applicable law, or as otherwise consented to by you. Marshall will not sell, rent, license, or trade your Personal Information to third parties for their own direct marketing use unless we receive your express consent to do so.

Marshall uses “cookies” to collect information. A cookie is a small piece of data file that downloaded to your device when you visit a website. Cookies are then sent back to the originating website on each subsequent visit to the site, or to another website that recognizes that cookie. Cookies are useful because they allow a website to recognize a user’s device. Outside of the use of the cookie settings in your browser, there are also browser-specific settings like “Do Not Track” (“DNT”) or “Global Privacy Control” (“GPC”). Because the DNT signal is not widely adopted and is not a finalized standard, we do not respond to DNT signals. However, as the Site provides a site-specific preference indicator (via our “cookie banner”), the Site does not act on GPC signals.

Messages and Transactions

Comments or questions sent to us using email or secure messaging forms will be shared with our staff and health professionals who are most able to address your concerns. We will archive your messages once we have made our best effort to provide you with a complete and satisfactory response. However, other than described below, these communications will not become part of your medical record or a designated record set unless and until, in each instance, you are seen and examined in person by a Marshall healthcare professional.

Information Sharing and Disclosure

We will not rent, sell, or share Personal Information about you with other people or non-affiliated companies except to provide the Service, when we otherwise have your permission, or under the following circumstances:

Service Providers. We may employ third-party companies and individuals to process your payments, facilitate our Service, to provide the Service on our behalf, to perform Service-related services (including, without limitation, maintenance services, security services).

Legal and Administrative Reasons. We may disclose your information without notice when:

  • Required by law or to comply with a court order, subpoena, search warrant, or other legal process.
  • To cooperate or undertake an internal or external investigation or audit.
  • To comply with legal, regulatory or administrative requirements of governmental authorities (including, without limitation, requests from the governmental agency authorities to view your information).
  • To protect and defend the rights, property, or safety of us, or subsidiaries and affiliates, and any of their officers, directors, employees, attorneys, agents, contractors and partners, and the website service users.
  • To verify the identity of the user of our Services.

De-identified or Aggregated Data. We may share your information on an aggregated basis for any purpose in which your specific personal information is blinded, masked, or otherwise non-identifiable.

With Your Consent. We may share information consistent with this Website Privacy Policy with your consent.

Links To Other Websites

The Site may contain links to third-party websites that may offer information of interest. This Website Privacy Policy does not apply to those websites, and Marshall recommends reviewing those websites’ privacy policies individually. Marshall assumes no responsibility for any material outside of our Site, including any website that may be accessed through a link from our Site.

Security

We follow generally accepted industry standards to protect the information submitted to us, both during transmission and once we receive it.

If we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser or looking for “https” at the beginning of the address of the web page.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only staff who need information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Data Retention

We retain your data as long as necessary for the purpose for which it was collected. We may retain the data until the set retention period for the data expires. In some instances, such as to comply with a legal or tax obligation, we may be required to maintain data for a longer period.

You have the right to request that we change or delete any personal information you have provided by contacting us as provided below.

BY ACCESSING THE SITE, INCLUDING WITHOUT LIMITATION BY CLICKING TO ACCEPT COOKIES ON THE COOKIE BANNER OR BY REGISTERING, YOU ACCEPT WITHOUT LIMITATION OR QUALIFICATION THE CURRENT WEBSITE PRIVACY POLICY. This Website Privacy Policy may be revised from time to time as we add new features and services, as laws change, and as industry privacy and security best practices evolve. We display a version number and a date on the policy in the upper left-hand corner of this Website Privacy Policy so that it will be easier for you to know when there has been a change. If we make any change to this Website Privacy Policy regarding use or disclosure of Personal Information, we will provide advance notice on this Site. Small changes or changes that do not significantly affect individual privacy interests may be made at any time and without prior notice. By continuing to access or use the Site after we have posted a modification or have provided a notice of a modification, you are indicating that you agree to be bound by the modified Website Privacy Policy.
